The Abu Dhabi Court for Family and Civil and Administrative Claims obligated a company to pay a worker who returned to his country an amount of 500,000 dirhams, as compensation for sustaining permanent disabilities during his work in the company, as a result of the failure to provide conditions for industrial security in the workplace.

In detail, a worker filed a lawsuit against a company and demanded that it pay him five million dirhams in reparation for all the material, moral and moral damages he sustained, and obligate it to pay 12% legal interest, fees, expenses and attorney fees, after a criminal judgment was issued against it convicting and fining it 10,000 dirhams.

The forensic report indicated that the doctor was unable to examine the plaintiff as he was outside the country, and he was unable to return, but after reviewing the medical reports and documents, it was found that he was 38 years old, and fell from a height while working and was transferred to the emergency department of a hospital, and it was found that he had multiple fractures of the cervical vertebrae. and dorsal, and surgical intervention was done and parts of the vertebrae were removed, and alternative metal cages were placed, which is a permanent disability by 70%, the spleen was also removed, and multiple fractures of the left side ribs, which is considered a permanent disability by 25%.

The court stated in the merits of the ruling that what was established from the penal ruling was that the plaintiff was working for the company, and during the course of his work he fell from a height of 10 meters, which caused fractures to his back, neck, head, hand and leg, as well as to the rest of his body, and he was completely damaged, and he was taken to hospital. Without calling an ambulance, and after 10 days, he was transferred to his country with the intention of treatment, and the company did not grant him his rights.

She pointed out that the forensic doctor's report, which the court is assured of, because it was issued by a specialist, and the soundness of the foundations on which it was built, showed that the plaintiff had a permanent disability, and the court ruled to obligate the company to pay the plaintiff 500 thousand dirhams material and moral compensation, and the delayed interest is 4% of the The date on which the judgment becomes final and conclusive, with obligating the defendant to pay fees, expenses and attorney fees
