employer takes my passport and threatens to waive my entitlements.. what should I do?

Many businessmen, owners of establishments, businesses, and entities resort to violating the law by keeping their employees’ passports, and possibly seizing them; Alleging the discipline of performance and commitment of the worker or employee without thinking about escaping or leaving, after committing a violation or crime of any kind, and keeping the passport here is considered by employers as a guarantee of protection for them from the treachery of the sponsored in any way, and consequently the loss of the sums that resulted from his recruitment and others, as well as incurring other high fees; because of that.

Forgetting or perhaps ignoring what the law stipulates in this regard of not allowing them to keep the passport of the sponsored person, except by agreement and consent with him - with the exception of certain cases, including judicial rulings - and therefore the contract here is no longer a law of contract; On the basis of a decision taken by one party without agreement or the consent of the other..the withholding of the passports of the sponsored persons is seen by some workers as a sword lashing their necks from their sponsors, and this includes several complaints from them; The sponsor may be stubborn with the worker or employee if he requests his passport to travel to his country for an emergency, and the employer may force the worker to waive his financial dues if his services are terminated in return for handing him his passport, while forcing him to sign to receive it, and other negative images; As a result of keeping the passports of the sponsored.

Therefore, the UAE Ministry of Interior issued a decision that considers the passport as a personal document, and the law obliges its owner to keep it, and show it to government authorities if they request it, and no party may withhold the passport except by the responsible authorities, and this behavior entails a penalty of imprisonment and a fine .. About the justifications The issues raised for keeping the passports of the sponsored persons, the importance of the legal obligation to hand them over to them, the necessity for the sponsored person to enjoy his legitimate right to keep his passport with him, and the necessary guarantees to reassure the guarantors.
