محمد The United Arab Emirates (UAE) is taking measures to curb unlawful recruitment activities and has issued a warning that businesses that operate without a license might face fines of up to $272,000.

In the year 2023, the Ministry of Human Resources and Emiratisation (MoHRE) has identified 55 entities that are engaged in recruitment and mediation activities without obtaining the necessary permits from the Ministry. Among these entities are five social media accounts that were discovered in collaboration with the Telecommunications and Digital Government Regulatory Authority (TDRA).

Administrative penalties were imposed on those who violated the UAE Ministry's regulations. These penalties included fines, restrictions in the Ministry's records, and referral to the Public Prosecution. Additionally, the social media accounts that violated the regulations were disabled.

Alert for recruitment in the UAE

Under the Federal Decree-Law Regarding the Regulation of Employment Relationships, it is illegal to recruit or temporarily employ domestic workers without first obtaining a permission from the Ministry concerned with employment relations.

In accordance with the legislation, those who violate it may be subject to a minimum sentence of one year in jail and/or penalties ranging from AED200,000 ($43,400) to AED1 million ($272,300).

In accordance with the procedures and conditions outlined in the Federal Decree-Law Regarding the Regulation of Employment Relationships, its Executive Regulations, and all relevant Ministerial Decisions, Khalil Al Khoori, the Undersecretary for Human Resources Affairs at the Ministry of Human Resources and Emiratization, stated that "Legislation prohibits engaging in recruitment and mediation activities without obtaining the required permits from the Ministry of Human Resources and Emiratization."

"The Ministry is committed to enforcing legal measures and penalties against any company that is proven to be involved in such activities without the appropriate licensing,"

Through the proactive detection of parties advertising recruitment or mediation activities, cross-referencing their data in the Ministry's records, and taking legal action against those practicing without the necessary permits in the UAE, he highlighted the effectiveness of the inspection systems of the Ministry of Human Resources and Emiratization (MoHRE) in flagging violations.

Inspection inspections are also carried out by the Ministry in order to identify businesses that are suspected of engaging in illegal activities and to report any instances of violation to the Public Prosecution.
